We provide the platform and technology to facilitate transactions but are not a party to the transactions between buyers and sellers.

To access certain features of the Service, you must create an account. You agree to:

• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years of age or have parental consent

4. Buyer Terms

As a buyer on our platform, you agree to:

• Pay for items you purchase in full at the time of checkout
• Provide accurate shipping information
• Communicate respectfully with sellers regarding orders
• Review and understand seller policies before making purchases
• Report any issues with orders through our designated channels

5. Seller Terms

As a seller on our platform, you agree to:

• Provide accurate and complete descriptions of your products
• Ship orders within the timeframes specified in your listings
• Comply with all applicable laws regarding product safety and labeling
• Maintain appropriate business licenses and tax registrations
• Respond to buyer inquiries in a timely manner
• Honor your stated return and refund policies
• Only sell products that are handmade, handcrafted, or produced in Montana

6. Prohibited Activities

You may not use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Post false, misleading, or fraudulent content

7. Payments and Fees

All payments are processed through our secure payment partners. Sellers are responsible for any applicable platform fees and payment processing fees as outlined in our Seller Agreement. Buyers are responsible for the full purchase price plus any applicable shipping costs and taxes. We reserve the right to modify our fee structure with reasonable notice to affected parties.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by 406 MT Makers and are protected by copyright, trademark, and other intellectual property laws. Sellers retain ownership of their product images and descriptions but grant us a license to display and promote their content on our platform. You may not copy, modify, or distribute our content without express written permission.

9. Limitation of Liability

406 MT Makers is a marketplace platform and is not responsible for the quality, safety, or legality of items sold by third-party sellers. We do not guarantee that products will meet your expectations. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any transactions conducted through the platform.

10. Dispute Resolution

In the event of a dispute between buyers and sellers, we encourage direct communication to resolve issues. If resolution cannot be reached, you may contact our support team for assistance. Any legal disputes arising from these Terms or your use of the Service shall be governed by the laws of the State of Montana and resolved in the courts of Montana.

11. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in effect.
